These Terms & Conditions and our Privacy Policy apply when you use our website makeitglutenfree.co.uk and purchase any items from us. Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms & Conditions and/or our Privacy Policy, please do not register with us. Please note we will update our Terms & Conditions from time to time, by using the services after any changes have been posted, you agree to the new terms. We will announce any changes to the Terms & Conditions on our website.

1. Your Account

1.1 To use our website you will need to set up an account with us. Please make sure that your details are correct and kept up to date and for ensuring that your password is secure.  If you think that your account is being used by anyone else, please contact us immediately. If we believe that your account has been compromised, we may suspend your account and we will contact you to try and resolve the problem.
1.1.2 We may refuse any application to join our website or receive our services for any reason whatsoever.  
1.1.3 If you have any problems creating an account, logging into your account or updating your details, please contact us.  

2.  Place of performance and applicable law. 

Make It Gluten Free Limited is a company registered in England. Unless otherwise specified, the material on this site is directed at those who access this site from UK mainland.  Make It Gluten Free Limited makes no representation that any product referred to, and the materials on this site, are appropriate for use or available in other locations. Those who choose to access this site from other locations are responsible for compliance with local laws, if and to the extent local laws are applicable. English law shall govern this Agreement.

3.   Pricing

3.1 The prices which you must pay are set out on the website at the time you place your order plus the delivery charge.

3.2 While we try to ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a refund.

3.3 All prices, where applicable, include VAT at the appropriate rate.

4. Placing an order

4.1 After you have created an account with us you can make a purchase by clicking on the “Buy Now” button next to the product.

4.2 Our ordering process allows you to review and amend your order before you move to the payment page.

4.3 You will then be asked to submit your payment details in accordance with our accepted payment methods.

4.4 Once you click on the “Confirm and Pay” button we will process your payment details and you will not be able to cancel your order. No order is accepted from you until our website displays an order confirmation message. Once you have placed an order with us you cannot amend or cancel this order in any way.

4.4 If an item is out of stock when we process your order we will process the remaining items so that we get the rest of the order to you as soon as possible. If an item is out of stock it will need to be the subject of a fresh order which complies with out Terms & Conditions.

5. Returns and refunds

5.1    We are committed to supplying high quality products that we are sure you will enjoy. Please make sure that you check your items carefully before they are purchased. We also recommend that you keep a copy of your receipt and/or order number, which can be found on your order confirmation or on the delivery packaging, as you might need proof of purchase in the event of any aftersales queries.

5.2 If you are unhappy with any product that you receive from us, please contact us at customerservices@makeitglutenfree.co.uk, sending a photo of the product.

5.3 We will only offer a refund for faulty products, we are not able to accept order cancellations, offer refunds or allow the return of products for any other reason due to their perishable nature.

5.4 If the fault is agreed, a full refund will be given for the returned goods within 7 days. We reserve the right to refuse a refund on any product.

6. Content
6.1    Our suppliers supply the ingredients and dietary information which we display on our website, we do not make any warranties as to the accuracy of this information and we do not assume any liabilities.

6.2    While we take every reasonable precaution to ensure product information is kept up to date, information can be wrong or ingredients can change, you must check these products before consuming/using to ensure they are free from the allergens you are avoiding. We cannot take responsibility for any errors made or if you purchase any of these products and then find them to be unsuitable. Please check very carefully before consumption. 

7. Limitation of Liability

7.1    Nothing in this Agreement shall affect the statutory rights of any consumer.

7.2    Nothing in these terms limits or excludes our liability for:

  1. Death or personal injury by our negligence

  2. Fraudulent misrepresentations

  3. Any other liability that cannot be excluded by law

7.3 If any part of these terms and conditions are deemed to be unenforceable the enforceability of any other part of these terms will not be affected.

7.4 This contract is between Make It Gluten Free Limited and yourself. No other person has the rights to enforce any of its terms.

7.5 You may not assign, sub-licence or otherwise transfer your rights or obligations under these terms to anyone else. You agree that we may assign or transfer any of our rights or obligations under these terms.

7.6 We will not be liable to you for any lack of performance, or the unavailability or failure of our website or our services, or any failure by us to comply with these terms, where such lack, unavailability or failure arises from any cause reasonably beyond our control. 

7.7 These terms, and any contract between us, are in the English language. The contract between us shall be governed by and interpreted in accordance with English law and the courts of England and Wales shall be non-exclusive jurisdiction to resolve any disputes between us.

8. Delivery

Delivery times quoted are estimates only, and Make It Gluten Free Limited shall not be liable for any delays caused except to the extent caused wilfully or negligently by us.

However, unless we have agreed a longer period for delivery with you, we will either dispatch goods within 48 hours (UK mainland only, excluding Saturday and Sunday) of your placing the order or we will let you know as soon as it will not be possible to meet this obligation. If we do let you know, then we will either agree a new delivery time with you or, at your request, refund any monies paid by you in respect of the delayed goods.

Delivery costs are weight and volume based. We use a courier service (next working day) and Royal Mail (Special Delivery Service) to dispatch goods to the UK and Northern Ireland and a courier service for European deliveries of 2-7 days from despatch. Delivery times are estimates only.

In the unlikely event that an order is lost, damaged or delayed we won’t be able to cover for any damages or losses beyond that of replacing the goods. Please let us know of any problem as soon as you can and within 24 hours of delivery.

If you leave an instruction for the courier to leave the parcel elsewhere if you are not at home without signing for it you immediately waive your right to compensation if the item is damaged or stolen as it isn’t possible to guarantee its integrity after delivery.

This website is only for delivery of products within the UK and Europe. All goods despatched by courier must be signed for by an adult aged 18 years or over at the time of delivery. 

9. Intellectual Property

By entering this website you acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this website shall remain at all times vested in us. You are permitted to use this material only as expressly authorised by us.

You further acknowledge that any other use of the material and content of this website is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

10. Recipes

All recipes on this website are the property of Make It Gluten Free Limited.

Although we and our suppliers have trialled and tested each recipe, we do not offer any guarantee of the quality of the results achieved by individuals who follow our recipe guidelines. Once submitted, recipes become the property of Make It Gluten Free Limited. The decision to add submitted recipes to our recipe listing pages on our site shall be made by Make It Gluten Free Limited.

Recipes submitted to us by visitors to the site must be of that individual’s creation, and must not contravene any copyright or intellectual laws.

11. Matters beyond our Reasonable Control

Make It Gluten Free Limited shall not be held responsible for any breach of this Agreement caused by circumstances out of its control including, but not limited to, Acts of God, fire lightning, flood, or extremely severe weather, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees), acts or omissions or Internet services providers or acts of local or central Government or other competent authorities.

12. Right to suspend or cancel your registration

Make it Gluten Free Limited may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions. You can cancel this agreement at any time by informing us in writing. If you do so you must stop using our site. The suspension or cancellation of your registration and your right to use the makeitglutenfree.co.uk site shall not affect either party’s rights or liabilities.

14. Language

In the event of conflict or inconsistency between the terms of the English language version of this Agreement and any translation provided by us, the English language version shall prevail.

15. Severability

In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.
